Adult Sues Six Year Old Child For €38,000 After Ski Accident

An adult woman is taking legal action against a six year old girl over an alleged skiing collision in Vorarlberg, Austria at Hochhädrich Mountain in the Bregenzerwald forest near the Austrian/German border.

The child was part of a ski school group lesson when the child made a sudden turn in front of the woman. The woman fell and was seriously injured. She claims that she can no longer ski due to the incident.

The woman has already attempted to sue the ski instructor who was responsible for the child at the time of the accident. This was unsuccessful and dismissed by the courts, so now the woman is attempting to sue the child for €38,000. Any monetary rewards will be paid by the child’s insurance.

The six year old girl is being sued in the Austrian court system. It’s up to a judge to determine if the six year old can be held legally responsible for the accident. In Austria, children under 14 cannot be held responsible unless they can “understand the consequences of his or her actions.” Only time will tell if that applies in this case.

Skiing is known to be a risky sport and several experts have testified that both the woman and the child are equally responsible for the accident.

 

This unusual case should exam both existing laws and the inherent risks of skiing. Maybe we should all reconsider the safety of in-bounds ski resorts when they are crowded? Thoughts?
